These Terms of Service ("Terms") govern your use of Sortail, a macOS application developed and distributed by Infonet AS (Estonia). By installing or using Sortail, you agree to these Terms.
Sortail is licensed, not sold. Subject to your compliance with these Terms and the Mac App Store Licensed Application End User License Agreement, Infonet AS grants you a personal, non-transferable, non-exclusive license to use Sortail on Apple-branded devices that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that Sortail may also be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
Sortail offers a free trial and paid features ("Sortail Pro") sold through the Mac App Store. The subscription is annual at the price displayed on the Mac App Store; a one-time 7-day free trial converts to a paid subscription at the end of the trial period.
Auto-renewal: payment will be charged to your Apple ID account at the confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen package. You can manage and cancel your subscription by going to your account settings on the App Store after purchase.
All payment processing, billing, refunds, and subscription management are handled entirely by Apple. Sortail does not receive or store payment or billing information. Refund requests should be submitted to Apple via reportaproblem.apple.com.
You agree to use Sortail only for lawful purposes and in accordance with these Terms. You will not (a) reverse engineer, decompile, or disassemble the app except to the extent permitted by applicable law; (b) use the app to violate the rights of others, including intellectual property and privacy rights; (c) interfere with or disrupt the integrity or performance of any third-party services that the app interacts with, including Apple Mail and Gmail.
Sortail integrates with Apple Mail (via macOS Automation) and, optionally, with Gmail (via the Gmail API and OAuth 2.0). Your use of those services is governed by their own terms — including the Google Terms of Service and Apple's terms. Sortail's handling of data accessed via these integrations is described in the Privacy Policy.
Infonet AS is solely responsible for providing any maintenance and support services with respect to Sortail, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to Sortail.
Infonet AS, not Apple, is responsible for addressing any claims by you or any third party relating to Sortail or your use of Sortail, including, but not limited to: (i) product liability claims; (ii) any claim that Sortail fails to conform to any applicable legal or regulatory requirement; (iii) claims arising under consumer protection or similar legislation; and (iv) intellectual property infringement claims.
In the event of any third-party claim that Sortail or your possession and use of Sortail infringes that third party's intellectual property rights, Infonet AS, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim, to the extent required by these Terms.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You and Infonet AS acknowledge that these Terms are concluded between you and Infonet AS only, and not with Apple, and Infonet AS, not Apple, is solely responsible for Sortail and the content thereof. These Terms do not provide for usage rules that are in conflict with the Apple Media Services Terms and Conditions as of the effective date you accept these Terms. To the maximum extent permitted by applicable law, Apple has no warranty obligation whatsoever with respect to Sortail. In the event of any failure of Sortail to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for Sortail to you, if applicable. Infonet AS and you acknowledge that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
Sortail is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Infonet AS does not warrant that the app will be uninterrupted, error-free, or free of harmful components, or that any data processed by the app will not be lost or corrupted. You are responsible for maintaining backups of your mail and other data.
To the maximum extent permitted by applicable law, Infonet AS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or business, arising out of or related to your use of Sortail. The total aggregate liability of Infonet AS for any claim arising out of or related to these Terms or the app shall not exceed the amount you paid for the app in the twelve months preceding the claim.
You may stop using Sortail at any time by uninstalling it. Infonet AS may suspend or terminate your license if you materially breach these Terms. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and governing law) will survive.
We may update these Terms from time to time. If changes are material, we will update the version number and date above. Continued use of the app after changes constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Republic of Estonia, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or the app shall be subject to the exclusive jurisdiction of the courts of Estonia, except where mandatory consumer protection law of your country of residence provides otherwise.
